In the last few days, we are flooded by emails from concerned Indian students, especially from Hyderabad about the use of ankle monitors on some of the Tri Valley Students suspected of visa related fraud. Hyderabad is consistently one of the top three cities in the world for the incoming traffic to app2us.com. Naturally we are concerned about the matter as we value Hyderabad and its residents. So we decided to dig deep in the matter and bring out some facts, as against the irresponsible journalism by some of the newspapers and news channels.</p>
<p>Our first task was to find out what is the ankle monitor and what is its intended use. We did some independent research and tried to talk to experts We summarize our opinion at the end. </p>
<p><strong>What is the ankle monitor normally used for?</strong><br />
Omnilink based in Georgia is a leading manufacturer of GPS enabled ankle monitors. According to Omnilink the use of ankle monitor covers a wide range which can be broadly classified into voluntary people tracking and tracking related to the criminal justice systems.</p>
<ul> Private usage:</p>
<li>Patients suffering of diseases like Alzheimer’s and Dementia</li>
<li>	College and school Students (monitored  by their parents)</li>
<li>Children (monitored by their parents)</li>
</ul>
<ul>
Corporate usage:</p>
<li>Mobile Workers  (monitored  by their employers, with consent)</li>
<li>Lone Workers (monitored  by their employers, with consent)</li>
</ul>
<ul>
Criminal Justice system related:</p>
<li>Sex Offenders</li>
<li>	Domestic Violence Offenders</li>
<li>Domestic Violence Victims </li>
<li><strong>Pre-trial Defendants</strong></li>
<li>Parolees </li>
<li>	House Arrest Participants </li>
<li>Truant Students </li>
<li>Gang Members</li>
</ul>
<p><strong>What are the obvious facts that can be safely inferred from the above list?</strong><br />
1.	None of the above are animals<br />
2.	Many of the above are obviously not criminals</p>
<p>In addition, RFID ankle monitors are used on newborns in most hospitals in US, some in India, to prevent the theft of a newborn baby.<br />
<strong><br />
Expert opinion on Ankle monitors: Dr. Robert Gable</strong><br />
We decided to talk to a renowned academic authority on the subject. We reached out to Dr. Robert Gable, co-inventor and pioneer of the device. Dr. Gable is currently an emeritus professor of psychology at Claremont Graduate University. He received both a doctorate in education from Harvard and a doctorate in experimental psychology from Brandeis in 1964. Much of his professional work has centered on developing behavioral therapy for juvenile delinquents, including remote radio-frequency monitoring of physiological responses. Dr. Gable was kind enough to talk to us at a short notice. After providing the context of and reason behind the query we asked him, &#8220;Dr. Gable, What is your opinion on the use of RFID Ankle Monitors on people suspected of wrongdoing, but not convicted of any crime?&#8221; Dr. Gable took the pains of going through the Tri Valley news coverage before responding.<br />
His response: &#8220;The anklets should not be termed ‘collars’.  They are not put around the neck nor used on animals.  The devices are basically radio or GPS units that have a secure strap so that they cannot be removed.  They can be hidden under clothes; although a few people show them off and put decorations on them. </p>
<p>The purpose is to know where the person is that they will show up for a court appearance.  Normally, the person is allowed go to regularly scheduled activities such grocery shopping, school, or work.  A judge determines the &#8220;flight risk&#8221; of the person who is charged with a crime. If person does not have a permanent residence in the United States, an extended family in the U.S., a long-term regular job, or large commercial investments he or she is more likely to flee back to his or her home country.  Thus, these students would likely be considered a high &#8220;flight risk.&#8221;   The anklet will be taken off when they appear in court. Ankle bracelets are also used in &#8220;high flight risk&#8221; cases as an alternative to jail.  The technology is certainly more humane than spending time in jail waiting for a trial.&#8221;</p>

According to Wikipedia, a widely respected source of information, &#8220;An ankle monitor (commonly called a tether) is a device that individuals under house arrest are often required to wear. At timed intervals, the ankle monitor sends a radio frequency signal containing location and other information to a receiver. If an offender moves outside of an allowed range, the police will be notified. Ankle monitors are designed to be tamper-resistant and can often alert police to tampering attempts.&#8221; </p>
<p>The lady in the picture could be a patient of a mental disease, victim of violence or a suspected or known criminal. But she seems to be having a good time at the beach.</p>

<strong>Response of the US Embassy in India:</strong><br />
When contacted by app2us.com, the spokesperson of the US Embassy at New Delhi responded with a link to a recent press release which reasonably answers all the questions we wanted to ask. According to the press release, &#8220;Some of those involved in the Tri-Valley investigation have been issued ankle monitors. Use of ankle monitors is widespread across the United States and standard procedure for a variety of investigations, and does not necessarily imply guilt or suspicion of criminal activity. An ankle monitor sends a radio frequency signal containing location and other information to a receiver. It allows for freedom of movement and is a positive alternative to confinement during a pending investigation.&#8221;<br />

<p>It is worth noting that in an exclusive interview with app2us.com in 2010, the current US Ambassador Timothy Roemer had said,  &#8220;Last year, we opened a new Consulate General in Hyderabad and are in the process of constructing a new consulate facility for Mumbai. We&#8217;ve also enhanced fraud prevention capabilities across India to protect applicants from unscrupulous touts and vendors.&#8221;<br />

app2us.com analysis:</strong><br />
Out of 1500 students some 18 students  were subjected to the ankle monitors (source: Consul General of India at San Francisco as quoted in TOI. [1]). Most people from any country or culture if given a choice between detention and ankle monitors would choose detention&#8230;oops, ankle monitors. That is what approximately 18 students did. Remaining approximately 1482 students were not subjected to the monitors.</p>
<p>In our opinion it is not a matter of national or Andhra pride. It is rather a matter of self-introspection and points to the importance of exercising great care in trying to study or work abroad.  People need to think why the percentage of Indians at an allegedly sham university was 95%? What is the % of Indians at MIT or Stanford?</p>
<p>The US Embassy in India can only do so much. A high percentage of Tri Valley Students traveled to US on the visa and I-20 of reputable universities and transferred to Tri valley. Having experience with education system in the US, we can comment with reasonable confidence that when a student transfers from a good university to one like the Tri Valley her intentions cannot be purely academic in nature.</p>
<p>However the US authorities need to do more.  In March 2010 an Indian student was killed in Oklahoma. When that happens, the news comments in India are full of mistrust towards US.</p>

<p>No government can prevent random killings. What the US could have done in this case was to look at the news carefully. While it is not totally unexpected for a young man to get killed in any country, it is very less likely to get killed in Oklahoma when you are a full time international student in California, and you recently landed in USA and classes are in session and it is still your first semester. If the ICE, US Embassy  and prospective students looked closely at the matter, Tri Valley case could have been stopped.</p>
<p>We believe Tri Valley is the tip of the iceberg. Such practices exist elsewhere. It is high time students stop wishing to go to US by any means to any university and try to earn money outside the university campus. </p>

<p>“According to the complaint, more than 95 percent of students were from India. For more than half of them, the university reported their address was a single apartment in Sunnyvale. The apartment manager told ICE agents that four university students lived there from June 2007 to August 2009 and none since.”</p>
<p>“The complaint, filed by the U.S. District Attorney&#8217;s Office on Wednesday, claims Su was part of an elaborate scheme to defraud, using false statements and misrepresentations to the Department of Homeland Security.”<br />
&#8220;Since its inception &#8230; Tri-Valley University has been a sham university, which Su, and others, have used to facilitate foreign nationals in illegally acquiring student immigration status that authorizes them to remain in the United States&#8230;&#8221; </p>
<p>“According to the complaint, Su and Tri-Valley University have made millions of dollars in tuition fees for issuing the visa-related documents, enabling foreign nationals to obtain illegal student immigration status.”</p>
<p>We at app2us.com have no first hand knowledge of the details of above news and we don’t know what exactly happened in this case. However, in light of wide publicity of this news worldwide, we would like to educate all our readers that if you get a guaranteed admission offer from a US university or its agents and some or more of the following is part of the deal, get alarmed and run away.</p>

<p>We encourage our readers to seek admission to the best possible universities. Through our blogs and forums we have always maintained that just going to US for the heck of it has no value and such students who wish to go to bottom ranked and unknown universities [legal or illegal] have no future, neither in US nor anywhere else in the world.</p>
<p>Hope this incident and the hoopla in the media surrounding the use of radio tagging on some students of the Tri Valley University help the prospective students understand the value of gaining a US education at a good university and by following rules.</p>
<p>Another important fact to note is that, the alleged sham university is still listed on SEVIS website as a SEVIS approved university.</p>

<p>That makes it very difficult for unsuspecting students to differentiate such universities. However if you really desire to get quality education in the US, you will very likely not be in the same boat as the Tri Valley students find themselves in.</p>

But if you are actively looking to anyhow go to USA to any university study anything and earn $$ anywhere, then you are not doing yourself a favor.</p>
<p>One important point [which these students apparently did not follow] If you seek to <a target="_blank" href="http://www.app2us.com/application/transfers.htm">transfer</a> Universities, do it for good academic reasons, always transfer to a better and higher ranked University and follow all DHS rules about the transfer paperwork.</p>

The purpose of this post is to increase awareness about the law among the students, specially the international students, and explore how it impacts those currently studying in, or planning to study in the state of Arizona. This post is in response to many questions we have received from worried students and their parents. Needless to mention, app2us.com is not a legal advisory service and please seek legal advise from qualified attorneys, if you need.</span></div>
<div><span style="font-family: verdana;"><strong> </strong></span></div>
<div><span style="font-family: verdana;"><strong>Here is the summary of the most contentious and relevant part of the new law:</strong> Law enforcement can ask you to prove that you are legally in the US. To do that you need to carry the papers that prove your legal status. If you are legally in the US it does not seriously impact you, but if you are not carrying any proof, it will lead to hassle, wastage of time and a possible short detention.</span></div>
<div><span style="font-family: verdana;"><strong> </strong></span></div>
<div><span style="font-family: verdana;"><strong>Here is the highlight of the law:</strong> The act makes it a crime for any citizen of another country to be in Arizona without carrying registration documents required by federal law, and obligates police to make an attempt, when practicable, to determine a person&#8217;s immigration status if there is reasonable suspicion that the person is an illegal alien. A person is &#8220;presumed to not be an alien who is unlawfully present in the United States&#8221; if he or she presents any of the following four forms of identification: (a) a valid Arizona driver license; (b) a valid Arizona nonoperating identification license [the <a href="http://app2us.com/blog/travel-and-transport/getting-a-state-identification-card-at-the-driving-licence-office/" target="_blank"><strong>State ID issued by Arizona Motor Vehicle Division</strong></a>]; (c) a valid tribal enrollment card or other tribal identification; or (d) any valid federal, state, or local government-issued identification, if the issuer requires proof of legal presence in the United States as a condition of issuance.</span></div>
<div><span style="font-family: verdana;"><strong> </strong></span></div>
<div><span style="font-family: verdana;"><strong>Here is what it means in Simple English:</strong> If you are illegally in the United States, you are inviting trouble, and inviting serious trouble if you happen to be in Arizona. If you are legally present in United States, you need to carry some document to prove it. In other states, police can ask for immigration papers if and only if you are involved in or suspected of some other crime. In Arizona, police can ask for your immigration papers if they think you may be illegally in the United States. The level of education awareness and training of the police can vary and if you look, speak or behave differently, you can safely conclude that you are more likely to be stopped than a local person. The biggest problem that we foresee here that most local police officers would not have heard of words like F-1, D/S, OPT, CPT and many would have not seen an I-20 in their lifetime. So it can become very complicated to explain to them that you are indeed in legal status despite, say, your expired visa. Read <a href="http://www.app2us.com/visa/student-visa.htm" target="_blank"><strong>this page</strong></a> to understand the concept of visa and status.</span></div>
<div><span style="font-family: verdana;"><strong> </strong></span></div>
<div><span style="font-family: verdana;"><strong>Be prepared:</strong> We strongly recommend all international students and their family members to obtain a state identification card. Always carry a driving license or state id issued by Arizona. If you are traveling from another state, carry the driving licence or the state ID from your state of residence. If you are new in US, and yet to obtain the state ID, carry your passport. If stopped by the police, do not panic and do not try to run away, and try to answer what they ask and do not answer what they don&#8217;t ask. Always carry the name and phone number of your international student advisor and give that to the police officer for verification of your status with the university. Once you have this ID, you will not have to explain your F-1, D/S, OPT, etc which very few police officers would understand.</span></div>
<div><span style="font-family: verdana;"> </span></div>
<div><span style="font-family: verdana;">We encourage all applicants to universities in Arizona to be aware of this law and increase their knowledge and awareness about this law. So far we see nothing serious and are not advising applicants to change their plans based on this law. However, at the end of the day those with multiple admission offers need to evaluate the offers in totality, and if they decide to study in a state which they perceive to be more friendly to people of all types and origins then it could be a loss for universities in Arizona. <p>Since most people understand what is a driver / driving license, let us begin by explaining what is a state issued ID card. In almost all states of the US, the same office that issues driving license, issues an identification card, which contains the holder&#8217;s photograph and is valid for almost all purposes including domestic air travel. Of all activities and situations where a driving license is acceptable, the state ID is not accepted for only one activity &#8211; driving!. This card looks almost like a driving license. Even if you have an international driving license that does not help you much to prove your identity for the purpose of renting, opening a bank account etc, but this card does.</p>
<p>The state ID card is meant for any legal resident of the United States who is not interested or not eligible to drive. Most common examples are children and senior citizens who have given up on driving due to health reasons. However there is a third category of people who should get this card &#8211; international students and their family members. As you can imagine once you land in the US, driving a car is not an immediate need or possibility for most. There are urgent things to be taken care of like finding a source of funding, registering for classes, finding a place to stay and a roommate and so on. So most of the international students do not get the time to learn or practice driving in the first few semesters. All this while only formal proof of identity and the legal status is the combination of the passport and the I-20. Needless to say it is impractical and foolish to carry your original passport to classes and other places you visit. It can get mutilated, lost or stolen. If you happen to be in Arizona, you do not have the luxury of not carrying any formal documentation. So you need to carry a small and convenient identification and there is only one document that can serve that purpose, the state ID. We strongly recommend all international students to visit the local driving license office within the first week of their arrival in the US and get the state ID card. It is not expensive, costs about $20 to $30. You need to go there with your original passport, I-20, admission letter, and the proof of your rental accommodation if you have one and enough cash to pay for the fee. Take an appointment online if that is an option.</p>
<p>Those who have a valid US driving license do not need the identification cards. If you have a valid driving license from another state of the US, you need to get one where you are currently living. In most states it is illegal to have both the documents, meaning if you first got the identification card, you need to surrender it when you get the driving license. Students must understand that the university issued ID card is neither valid nor considered an authentic form of identification outside the university campus. Always carry the state id card specially if you are in Arizona. The biggest advantage of this card is that it simplifies local air travel, and eliminates the need to carry your passport. And yes, this is accepted at all bars and pubs to prove that you are above 21.</p>

Identity theft is one of the biggest and fastest growing crimes in the US. It involves stealing and misuse of your personal information like date of birth and social security number. That information in turn is used to open fake accounts so that the victim ends up owing money and with a bad credit report. If you are thinking that this is the time to complete university applications, and you will bother about this after starting your education in the US, you are mistaken. As soon as you start applying to US universities, you are a potential target for the identity thieves and your identity can be stolen even before you set your foot on the US soil.<br />

International students are at a high risk due to two factors:<br />
1. There are cultural differences they take time to adjust to &#8211; for example, date of birth is very private information in the US, and someone who knows your date of birth can steal your identity. But in some parts of the world it is so public information that students and job seekers write their date of birth on their resume! Bottom-line, stop mentioning your date of birth, except in the required field in the application. Don’t write your date of birth on your resume or other application documents.<br />
2. Despite being very familiar with the internet, most international students have limited experience with shopping online and using a credit card over the internet.<br />

No matter how much precautions are taken, anyone’s identity can be stolen. In the recent past, many mass identity thefts have taken place by hacking into servers of U.S. universities. Thieves have allegedly stolen record of millions of students, including of those who applied to that university, but did not even enroll. The only thing you can do is to monitor your credit file periodically (say once every six months) and take appropriate action if your identity is stolen. For example, your credit report may show a credit card you opened last month, which you are sure you did not open. You must contact that credit card provider and explain the facts to them. Universities or other large entities whose servers are compromised usually do a good job of informing all people whose data was stolen or is suspected to have been stolen, but beyond that it is the responsibility of the individual.<br />

We highly recommend accessing your credit report and credit scores within the first six months of getting your social security number. In rare circumstances, you might be allocated a social security number which is already being used by a identity thief.
